I, the undersigned parent or guardian, do hereby grant permission for my daughter(s)/son(s), whose name(s) is above, and hereinafter shall be referred to as “participant,” to participate in the activities run at 2268168 Alberta Ltd., 2117373 Alberta Ltd., 2107944 Alberta Ltd. operating as Premier Academy and associated events.


DISCLAIMER CLAUSE


PREMIER ACADEMY Directors, Agents, contractors, employees, coaches/instructors, trainers, volunteers, members and representatives are not responsible for any injury, loss or damage of any kind sustained by any person while registered as a PREMIER ACADEMY member and participating in any and all PREMIER ACADEMY sanctioned activities, events, practice sessions or social activities (all hereafter referred to as “PREMIER Activities”), including injury, death, loss or damage.


DESCRIPTION OF RISKS

In consideration of the participants membership and /or participation in PREMIER Activities, I acknowledge that I am aware of the possible risks, dangers and hazards associated with being a member, including the possible risk of severe or fatal injury to myself/the participant or others. These risks include but are not limited to:


1. All manner of injuries resulting in muscular injuries and soft tissue injuries including bruises, scrapes, cuts etc, from executing strenuous and demanding physical techniques, collisions with walls, floor, ceilings and contact with other participants and failure in proper execution of techniques either by myself/the participant or other participants;


2. all manner of injuries resulting in sprains, dislocations, concussion, broken bones, hematomas, whiplash, contusions, pulled or strained muscles, torn ligaments, muscles and tendons, joint strain and sprain, and bruising to the tail bone, wrists, legs, arms, back, neck and injuries to the gluteus maximus, pulled groin muscle, and heart attack/stroke; head, facial, eye and/or dental injuries;


3. all manner of spine or spinal cord injuries which may render me permanently paralyzed;


4. all manner of injuries, severe or fatal, resulting cuts, tears, bruises or punctures caused by shoes, finger nails, jewelry, hair accessories or props either from myself/the participant or another cheerleader;


5. transmission of diseases or skin diseases in various ways and types from contact with other participants resulting in death, disease or other illnesses;


6. all manner of medical problems resulting from heat exhaustion, asthma, communicable diseases, skin rashes, and cramps;


7. all manner of internal injuries of body parts and organs, and trauma to larynx or pharynx;


8. that my/the participants risk of injury increases as I/my child become fatigued, experience pain, frustration, and /or performance anxiety;


9. all manner of injuries and/or death that may result from transportation (all modes or types) used to and from PREMIER Activities.


In consideration of PREMIER ACADEMY allowing me/the participants membership and participation in PREMIER Activities, I agree as follows:


1. TO WAIVE ANY AND ALL CLAIMS that I/the participants have or may have in the future against PREMIER ACADEMY, their directors, agents, contractors, employees, coaches/instructors, trainers, volunteers, members and representatives as a result of my membership and/or participation in PREMIER Activities;


2. TO RELEASE THE CLUB from any and all liability above and beyond the provided coverage, from any loss, damage, injury or expense that I may suffer, or that my next of kin may suffer as a result of my membership and/or participation in PREMIER Activities due to any cause whatsoever, including Breach of Contract, or Breach on and Statutory or other Duty of Care, including any Duty of Care Owed under the Occupiers’ Liability Act, RSA 2000 C. 0-4 on the part of PREMIER ACADEMY;


3. TO HOLD HARMLESS AND INDEMNIFY PREMIER ACADEMY from any and all liability for any damage to the property of, or personal injury to, any third party, resulting from my membership and/or participation in PREMIER Activities;


4. TO HOLD HARMLESS AND INDEMNIFY PREMIER ACADEMY in connection with the services and/or incidents/accidents of any train, vessel, carriage, aircraft, bus, privately owned or rented motor vehicle or other conveyance, which may be used during my/the participants membership and/or participation in PREMIER ACADEMY;


5. TO HOLD HARMLESS AND INDEMNIFY PREMIER ACADEMY for any cancellation, injury, loss accident or delay occasioned by the proprietor, employee, or service of any accommodation which may be used during my/the participants membership and/or participation in PREMIER ACADEMY;


6. TO FOLLOW all instructions and rules given by those responsible for or in charge of any PREMIER Activities while I am/the participants is a member and/or participating in PREMIER Activities. I am aware that the rules are in place to provide a safe environment for the entire membership; and


7. TO ACKNOWLEDGE and UNDERSTAND that cheerleading and tumbling requires the Coach to perform manual spotting, which involves direct physical contact and is designed to assist the participant in the safe performance of the program skills.


8. To UNDERSTAND that in case of emergency I will be contacted as soon as possible. All expenses in case of emergency will be assumed by me or my insurance carrier.


9. TO INDEMNIFY Premier and its directors, agents, contractors, employees, coaches/instructors, trainers, volunteers, members, representatives, successors and assigns (collectively, the “Indemnified Party”), from and against any and all liability, loss, damage, claims, suits, and expenses of any kind, including any action under any statutory or other duty of care, the Occupiers’ Liability Act or any other legislation, incurred by or asserted against the Indemnified Party relating to or arising out of the use of the facilities or the participant’s participation in Premier’s Activities. I further AGREE TO INDEMNIFY the Indemnified Party against any and all legal costs on a solicitor-and-own-client full-indemnity basis which may be incurred in defending any lawsuit or claim that any participant may bring against any of them.


Media/Appearance Clause: Permission is granted to use my daughter’s/son’s picture or image in any or all future advertisements, broadcasting, web site and marketing literature or promotional videos for PREMIER ACADEMY and/or and events sponsored and conducted by them. I hereby waive any right to compensation or any claim of ownership thereto.

1. I understand that practice attendance is MANDATORY. All efforts will be made to attend team practices. NEW In the past we have asked athletes who are not feeling well to attend practice even if it means just watching from the sidelines. This policy is no longer in effect and we require any athlete who is ill (cough, fever, sore throat, vomiting, etc) to stay home. Please notify your coach if you will be absent from practice for any reason via email or phone call to the gym.

2. I understand that all choreography camps are mandatory. Missing a camp may result in an athlete not being included in choreography.

3. I understand that if I choose to take cheerleading away as a punishment from my child, this will be considered an unexcused absence.

4. If an injury is incurred, athletes still need to attend team practices (sitting out on the side and/or doing what they can) to keep up with the routine and learn choreography.

5. If an injury keeps an athlete from participating in practice, Premier requires a doctor’s note or a note from a parent clearing to return, BEFORE they may participate again.

6. I understand that time management is expected. Although school is the #1 priority, homework/tests and studying are not valid excuses to miss practice.

7. I understand that coaches have the right to remove a member from performing at a competition if they miss a team practice leading up to a competition or if an athlete misses an excessive amount of practices prior to a competition. Premier Academy will issue a list of ‘Black Out Weeks’. During those weeks, any missed practices will result in either the athlete not being able to compete or being moved to a different position in the routine. When this happens, the athlete will be put back into the routine at the most convenient time deemed by the coaching staff. Understandably, the athlete may NOT return to their previous roles/ spots/formations to keep transitions and changes the simplest for the entire team. No competition fee refunds will be provided for missing a Black out Week practice.

1. I have reviewed the competition schedule and understand that a full commitment to attend ALL competitions and performances as scheduled is necessary.

2. I understand that athletes who miss a competition may be removed from the routine or moved to a different position in the routine for the remainder of the season.

3. All transportation to and from competitions is the sole responsibility of parents. I understand that some competitions require a specific hotel. Information will be given as those dates approach.

4. I understand that we live in Alberta and often have undesirable weather. Competitions run regardless of the weather and I understand that we will still be required to attend the competition.

5. Unexcused absences from a competition is subject to a $150 fee.

Other Policies

1. The Cheer Season is a full year commitment from June - April for All Star or September to April for Prep.

2. Routine & Level Changes: Throughout the season coaches will make changes to routines for a variety of reasons. Athletes should expect this and be prepared for their roles within a routine to change. Coaches and management also reserve the right to change a team’s competitive division during the season. This includes moving a team up or down a level.

3. It is the parent’s responsibility to stay informed. Check your email and Band Groups regularly. If you are not receiving emails, contact the front desk immediately. Each week you will receive a weekly email with updates and announcements. You can also log into the client portal to view all past emails that have been sent. If you click the opt-out button for emails, you will no longer receive any emails from Premier Academy

4. I understand that I may not reproduce any clothing or gear that contains the name or logo of Premier Academy unless you have written consent from the Premier Academy owners. I am also not permitted to contact any vendors on behalf of Premier Academy.

5. Abusive behavior including but not limited to bullying, on-line bullying, negative language by athletes or parents directed at a fellow athlete, coach, parent, official or competitor will not be tolerated.

6. Athletes and parents must conduct themselves in a manner that reflects positively on themselves, their family, and their gym.

7. We will not accept anything that undermines the culture of PA. Whether that is gossiping, a child coming in and spreading negativity to and around other athletes, or a parent coming in and spreading negativity to and around other athletes. Concerns can always be brought up by booking a meeting with coaches or ownership but being a negative influence that spreads attitudes that are not conducive to learning and improvement is unacceptable.

8. Drinking of alcoholic beverages or use of drugs while representing Premier Academy in any way will not be tolerated.

9. I am aware that if any of the above occurs in person or over social media/online, it will be grounds for dismissal from the program

Tuition and All-Star fees are processed on the 25th of the month by automatic process from the credit card provided. All members must have a valid credit card or Visa debit/MasterCard Debit on the account.

Any fees left unpaid by the 1st of the month will result in the athlete not being able to participate in practice/classes until the balance is paid. Additionally, a $25 late fee will be applied if not paid by the 1st of the month.

If a participant wishes to withdraw partway through the season, the following policy applies:
- Cancellation request must be submitted
- A cancellation fee equivalent to one-month tuition will be charged upon notification of cancellation
- All-Star fees are non-refundable once they have been processed
- Downpayment is non-refundable
- No refunds or discounts for missed practices
- Clothing and uniform fees are non-refundable once ordered
